INFORMATION ITEMS MJC Presidency A special welcome is given to Dr. Stan Hodges, who began as MJCs Interim President on July 2. His experience, knowledge and commitment to MJC and this community will serve us well over the next few months. In the meantime, the presidential search process is continuing. Position announcements have been distributed nationally and our consultant, Dr. Abel Sykes, is personally contacting and encouraging applications from highly qualified individuals. The time line calls for interviews to be conducted in September. Congratulations! We recently received news that four of our students have won scholarships from Townsend Press, one of the leading publishers in developmental education. Townsend Press is coming out with a new edition of their popular reader, Taking Charge of Our Lives. This is a heart-rending collection of essays written by developmental students who have overcome serious obstacles to academic success. In the next edition four of the thirty-three essays in this reader will be by MJC students. English professor Ann Smith reported that she used an application idea from her trip to the Museum of Tolerance to prompt students to write about conquering negativity about self and others. Our congratulations to professor Smith and her students! 3. MJC Title V Grant Award We are pleased and proud to announce that Modesto Junior College is one of only 45 colleges nationwide to receive a Strengthening Institutions Program grant for Hispanic Serving Institutions (HSI) from the U.S. Department of Education, funded under Title V of the Higher Education Act. This $2.07 million grant was sought to create a Center for Learning Assistance Across the Curriculum (CLAAC) at MJC. This center will redefine traditional learning assistance practices by adopting a new organizational structure and creating innovative programs that address students academic needs across the curriculum for all students, from developmental to university transfer-ready. Congratulations are due to the many staff who developed this proposal over the past year. 4. GED Celebration The annual GED graduation celebration was held at Columbia College on June 18. The new GED recipients, along with family and friends, attended to celebrate their accomplishments. Some of the students indicated that they are planning to continue their educational pursuits by enrolling in additional courses at Columbia College in the Summer and Fall Semesters. Louis Armstrong Celebration Columbia College and the College Foundation are cosponsoring a concert and presentation at Columbia College Carkeet Park on August 4, 2001, from 6:00 9:00 p.m. The event will celebrate Louis Armstrong and will commemorate his 100th birthday. Presentations also will be featured which celebrate Armstrongs contributions to music and his efforts to breakdown racial stereotypes. The event is funded by a grant from Met Life Financial Services Foundation to the College Foundation which was to be used to support the colleges Beyond Tolerance Initiative. This event is free and open to the public. MJC Foundation Summer Sonata The MJC Foundation will hold its summer gala on Friday, July 13. This highly successful event also is labor intensive and many staff have volunteered to work hard to make the evening go smoothly. Our thanks to all of them. State Budget Update As this agenda went to print, the California community college system was faring better than other segments of education in the 2001-2002 State Budget. The budget included the areas of student enrollment growth, cost-of-living adjustment, and part-time faculty compensation. In addition, a partial cost-of-living adjustment pertaining to Partnership for Excellence funds was added by the Legislature, which was not in the Governors May Revise. Overall, the funding is still considerably lower than anticipated six months ago before the energy crisis. In addition, the stalemate between the Republicans and Democrats is likely to prevent the timely adoption of the state budget which was due by June 30. Staff will provide an update at the meeting. MJC West Campus Village Update A revised version of the MJC West Campus Village concept has been developed by our partner, The Mehmet Noyan Company. Based upon previous input from the Board of Trustees, City of Modesto, and community opinions, certain elements of the concept plan have been modified to better reflect what the campus and community desire. Some of the revisions include the elimination of big box retail, an increase in the business park land use designation to include more office and job center clientele, and a more campus/community-oriented retail element. Retained are the Student Village and other services components helpful to the college community. Mr. Mehmet Noyan will be present to discuss these planned modifications, the new direction of the project, and the next steps. 9. MJC Firing Range Update As indicated at the June 5 Board of Trustees meeting, staff have implemented several new safety measures with regard to the firing range. Since that time, we also have continued to collect and assess additional information related to safety and health issues and concerns at the range. The conclusion is that to ensure maximum safety of students and passersby, the range will not be used until all issues are appropriately addressed. Local law enforcement agencies have agreed to provide alternate site options for Academy training on a short term, temporary basis until the new Modesto Police Department facility is completed. No non-Academy firearms classes will be offered until they can be offered at the new firing range. C. CONSENT AGENDA 1. q Purchase Orders RECOMMENDATION: That the Board of Trustees approve the purchase orders issued from May 1, 2001 through May 31, 2001. 2. Curriculum Inactivation RECOMMENDATION: That the Board of Trustees approve the Curriculum Committees recommendation of the inactivation of AUTEC 361, Breaking Systems for Modesto Junior College. This course is out of compliance. 5. Special Appointment - Riggs RECOMMENDATION: That the Board of Trustees approve the appointment of Dr. Jim Riggs, President of Columbia College, to the Board of Directors of the Economic Development Company of Tuolumne County for a three-year term beginning July 1, 2001 through June 30, 2004. Notice of Completion of Contract The contract for the Renovations of Auditorium Seating at Modesto Junior College East Campus, Bid #00-1465, has been completed and inspected. RECOMMENDATION: That the Board of Trustees accept the work performed by Country Roads Incorporated for the Renovations of Auditorium Seating at Modesto Junior College East Campus, Bid #00-1465, as having been completed in accordance with the plans and specifications, and authorize final payment to be made. qDenotes Attachment D. DISCUSSION ITEMS Student Services On-Line An integral aspect of attracting, enrolling and assisting students in 2001 is our ability to provide those services on line. Over the recent past our Student Services departments have used technology successfully to increase their automated services. Staff will make a presentation describing the options available to students and the regional project known as Webbing the Valley. RECOMMENDATION: That the Board of Trustees receive the report and commend staff for their efforts. 2. q Proposed Revision to Policies 4007 and 5017 (Smoking)  Second Reading In 1988 the Yosemite Community College District adopted a policy prohibiting smoking in all buildings except in designated areas. Since that time state law and district practice have evolved to the prohibition of smoking in all facilities and vehicles. In the past several years there has been increasing concern about second-hand smoke and smoking litter adjacent to buildings where staff and students must walk. Recently the YCCD Wellness Committee and the college councils have discussed and proposed a modification to policies 4007 and 5017. The proposed new policies are attached and the changes include prohibiting any smoking within 20 feet of an entrance to a building. This is the second reading and the proposal has been distributed to constituent leaders for their formal review and comment. RECOMMENDATION: That the Board of Trustees conduct a second reading of the proposed revised Board Policies 4007 and 5017 (Smoking). 3. q Proposed Revision of Policy #1000 (Use of College Facilities) - Third Reading Legislation passed in 1998 made it possible for alcohol to be served on community college campuses under very limited conditions, if the Board of Trustees has adopted appropriate policy. Both college foundations and both college presidents have requested that YCCD Policy #1000 be modified to include some changes. The proposed new policy is attached and would allow serving wine at foundation fund-raisers with prior approval from the college president and district chancellor. This proposal has been distributed to the leadership of constituent organizations and their 45-day response period is concluded. No objections have been received from constituent organizations. RECOMMENDATION: That the Board of Trustees conduct a third and final reading of the proposed revised Policy #1000. YCCD Proposal to CSEA, Chapter 420 On May 1, 2001, CSEA, Chapter 420, presented a bargaining proposal to the District. A public hearing of the proposal was conducted on June 5, 2001. The next steps in the process are the presentation of the Districts proposal to CSEA, Chapter 420, and the scheduling of a public hearing. RECOMMENDATION: That the Board of Trustees approve the following proposal to CSEA, Chapter 420, and scheduled a public hearing on August 7, 2001. As indicated, the proposal provides for renewal of the existing agreement for a new 3-year term (July 1, 2001 to June 30, 2004) with the following improvements: a. Compensation: The District proposes to maintain a competitive salary schedule for all members of CSEA, Chapter 420, during the term of this agreement subject to available resources. Compensation: The salary range and job class recommendations contained in the Killian Management Services final report shall be implemented on a phased in basis. Fringe Benefits: The District shall assume the increased cost of fringe benefit premiums as provided for in Section 12.5.1 through 12.5.5 of the existing agreement for eligible unit members and their eligible dependents during the 2001-2002 and 2002-2003 academic years. Term: This agreement shall continue in effect to and including June 30, 2004 and from day to day thereafter until the parties reach agreement on a successor agreement. Renegotiation: For the 2003-2004 academic year, either party may reopen negotiations on salary and/or fringe benefits. YCCD bargaining Proposal to YFA Public Hearing The current YFA/YCCD negotiated agreement expires on June 30, 2001. In compliance with Article 22.2.1 of the YFA/YCCD Faculty Contract, on February 28, 2001, YCCD presented its opening negotiations statement for the period beginning July 1, 2001. A public hearing of the proposal was conducted on May 1, 2001. On June 5, 2001, the District presented their proposal to YFA. Consistent with applicable code sections and district policy, it is necessary for the Board of Trustees to conduct a public hearing on the districts proposal. RECOMMENDATION: That the Board of Trustees conduct a public hearing regarding the YCCD bargaining proposal to YFA. q 2001-2002 Appropriations Limit Pursuant to direction provided by the Board of Trustees action during the meeting of June 5, 2001, the report establishing the District s 2001-2002 appropriations limit has been publicly posted. The Board, having declared its intent to adopt the report, must now do so consistent with law. RECOMMENDATION: That the Board Trustees adopt the report establishing the Districts 2001-2002 appropriations limit as required by law. q MJC Pavement Projects  Change Order 1 The Modesto Junior College Pavement Projects involves the construction of a new 220-space parking lot adjacent to the baseball field. Significant reconstruction and repair of the service road that runs from Stoddard to Coldwell behind Founders Hall and along the tennis courts also is part of this project. As you know, with construction projects there are often unforeseen situations that occur during demolition and/or during the course of work. Often there are existing situations that also need to be corrected. This change order includes work to provide lights at existing Agriculture buildings to improve safety and an upgrade to the electrical service for several of the existing Agriculture facilities. Included is work that was required to dry out the soil due to inclement weather, the relocation of an existing catch basin and importing soil that was needed in two separate locations of the parking area due to poor local soil. At the Stadium Drive area, several curbs and ramps needed to be removed due to their condition and/or location and an untimely condensate leak required removal and replacement of concrete work. These work items have resulted in Change Order 1 in the amount of $113,982.82, which represents approximately 15 percent of the total contract. RECOMMENDATION: That the Board of Trustees approve Change Order 1 in the amount of $113,982.82 for the Pavement Projects at Modesto Junior College. q Resolution Authorizing Signatures In order to conduct the districts day-to-day business, it is necessary for the Board of Trustees to authorize selected employees to act as agents for the Board.
