B.     INFORMATION ITEMS

 

1.        January Institute Days

 

Columbia College will hold its Institute Day on Thursday, January 4.  It will be comprised of technology training which will be conducted by staff.  MJC’s January 5 Institute Day theme is “Quality Education.”  The featured speaker will be Dr. Carol Tomlinson-Keasey, Chancellor of U. C. Merced.  Trustees are encouraged to attend both events.

 

2.        MJC Faculty Authors

 

MJC recently hosted a reception and published a brochure honoring more than 20 recently published faculty authors. These authors are to be complimented on their accomplishments.  President Sheehan will present the brochure and how it will be used.

 

3.        Columbia College:  Living Beyond Tolerance

 

Columbia College will host a forum entitled “Living Beyond Tolerance - the Oneness of Humanity” in observance of Martin Luther King, Jr.’s birthday.  The event will be held in the Dogwood Building on Sunday, January 14, 2001, beginning at 2:00 p.m.  Activities will include music, poetry, dancing, a panel discussion and speakers.  The event is co-sponsored by the Martin Luther King, Jr. Birthday Observance Committee and  Columbia College Community Services.  This is a free event and open to the public.

 

4.        Federal Legislative Update

 

The last Congressional session adjourned without passing the appropriations bill for education.  The legislative component which had been passed, most notably financial aid, was beneficial to our students if funded. In an unusual step, Congress convened in December to continue its discussion and possible action regarding the budget.  The latest available information regarding the outcome will be presented at this meeting.

 

5.        State Legislative Update

 

On January 19, Governor Davis will present his proposed state budget.  As always, this document serves as a starting point for subsequent budget discussion in the Legislature.  In addition, the Community College League of California will host a Legislative Conference on January 21-22.  At that time policy analysts and members of the Legislature will present their plans and goals regarding budget and other legislative issues.  Representatives of the Board of Trustees and District Council will participate in the workshop and in meetings with our local legislators.

 

6.        Televised Meetings

 

At the last Board of Trustees meeting a request was made to explore the feasibility of televising YCCD Board meetings.  Staff are conducting a study and review of the issues involved and will present a report at the February 7 meeting.

 

7.        Modesto Police Department Research Project

 

The YCCD has been asked to conduct a research study, including an analysis and recommendations, for the Modesto Police Department.  The focus is on possible racial profiling and the demographics of victims.  A team of faculty and administrators has been convened for this purpose.  The joint project was announced recently at a community workshop on hate crimes and was positively received by the community organizations represented that day.

 

8.        “Non-Violent: The Challenge to Ensure the Future

 

On Friday, January 19, Yolanda King, daughter of Dr. Martin Luther King, Jr., will speak at Modesto Junior College.  Ms. King’s topic will be “Non-Violent: The Challenge to Ensure the Future.”   This event will be held in the MJC gymnasium from 7:00 p.m.  to 9:00 p.m.  This free public event is being presented by the City of Modesto Recreation and Neighborhoods Department and is co-sponsored by Modesto Junior College, Modesto Peace Life Center, Modesto Bee, City of Modesto Human Relations Commission, and Frailing and Rockwell.  Everyone is encouraged to attend.

 

C.     CONSENT AGENDA

 

1.        q Purchase Orders

 

RECOMMENDATION:           

That the Board of Trustees approve the purchase orders issued from November 1, 2000 through November 30, 2000.

 

2.        Acceptance of Gifts

 

RECOMMENDATION:           

That the Board of Trustees accept with appreciation the following gifts:

 

a.      Books of assorted titles from Kathleen Ennis, Shirley Hausner, Donald Wolsey, Leo Reynolds, Ron Ramont and Hilda Sielicki, to be used for the Library at Modesto Junior College.

b.      A threading die head from Lee Precision Products to be used for the machine tool course at Modesto Junior College. 

c.      A donation of $1,500 from Moneyline America, LLC to be used for graduation expenses of the 144th Basic Police Academy at Modesto Junior College. 

d.      A donation of $350 from Fremont Toyota to be used for graduation expenses of the 144th Basic Police Academy at Modesto Junior College.

           

3.        Special Appointment - Tom

 

RECOMMENDATION:           

That the Board of Trustees approve the appointment of Bennett Tom to serve as a member of the Community College Advisory Panel to the College Board, Western Regional Office, beginning January 1, 2001.

D.     DISCUSSION ITEMS

 

1.        West Campus Village Project

 

For the past two and a half years, the Yosemite Community College District has worked with Mehmet  Noyan and Ed Kashian of KG-MN, LLC on the development of a joint project on the West Campus of MJC.  A number of documents were written and approved between June of 1998 and September of 2000. Meetings with staff and students have been held and focused on potential educational partnerships.  There are still many issues to be addressed and resolved before the project becomes a reality.  In addition, there are modifications to the plans which can be made if appropriate.  At this meeting our legal counsel  Ms. Marilyn Cleveland, project consultant Dr. Mike Maas, and partner Mr. Mehmet Noyan  will  be present to provide information and answer questions.

 

RECOMMENDATION:           

That the Board of Trustees receive the report and provide staff with direction.

 

2.        Board of Trustees Meetings

 

At the December Board meeting, trustees discussed the question of changing the regular Board meeting time to 7:00 p.m.  Approximately seven years ago, the Board changed their meeting time from 7:30 p.m. to 5:00 p.m.  Although not many community members attend regularly, Board members felt that the current time had not been a deterrent to interested community members or the media. For example, the MJC East Campus parking issue had extensive community participation as residents expressed frustration to student parking in their neighborhoods.

 

               In the discussion leading to the last change, consideration was given to the late night commute for Columbia and MJC faculty, staff, and trustees.  Also, the lack of available adequate facilities at Columbia during the evening hours was a concern.  As an aside, the earlier time change has resulted in more participation by MJC staff as the time does not conflict with night classes and family demands.  Staff will, of course, accommodate the choice of the Board of Trustees.

 

RECOMMENDATION:           

That the Board of Trustees consider their options and determine their regular meeting time for this year.

 

3.        YCCD Board of Trustees Handbook and By-Laws

 

The Board of Trustees operates according to formally adopted by-laws (Board Policy Manual Section 7000-7025).  In addition, trustees use the Community College League of California Trustee Handbook as a guideline for its policies and practices.  Recently YCCD subscribed to a CCLC board policy service that is provided by a team of legal experts in the Education Code.  Through this service, college districts are provided with sample policies that reflect required, recommended and best practices. Trustees may wish to review their policies by utilizing the new service as well. In addition, this topic could be part of a Board Retreat in the future.

 

RECOMMENDATION:           

That the Board of Trustees determine if and how they wish to conduct a review of their Board Policy By-Laws.

 

4.        Board of Trustees 2000-2001 Priorities

 

In June, the Board of Trustees reviewed college and district goals for 2000-2001.In September, at their annual retreat, trustees reviewed those again and a variety of other issues.  At that time they developed a draft set of their priorities for this academic year.  That draft was distributed to them in October and possible revisions solicited.  None were received and the draft statement was placed on the November 7 agenda.  On a vote of 6-0 the statement was approved by the Board of Trustees.  Recently, one trustee requested to have the Statement of the Board of Trustees’ Priorities placed on the agenda again.

 

RECOMMENDATION:           

That the Board of Trustees review the Statement of Board of Trustees’ Priorities.

 

5.        Nonresident Tuition Fee

 

The Board of Trustees is required to establish annually a nonresident student tuition fee for the succeeding year.  The 2000-2001 nonresident student tuition fee is $130. The 2001-2002 nonresident student tuition fee must be at or between the statewide average expense of per unit and the Yosemite Community College District’s expense per unit.  Staff will provide these expense per unit figures at the Board meeting.  (These figures are not yet available from the State Chancellor’s Office.)

 

RECOMMENDATION:           

That the Board of Trustees adopt a 2001-2002 nonresident student tuition fee based on the recommendation provided by staff.

 

6.        Modesto Junior College 1999-2000 Sabbatical Leave Reports

 

Final reports have been received and approved by the college president for the Modesto Junior College faculty who were on Sabbatical Leave in 1999-2000.

           

RECOMMENDATION:           

That the Board of Trustees accept the 1999-2000 Modesto Junior College Sabbatical Leave reports from the following faculty:

7.        q 2001-2002 Sabbatical Leaves - Columbia College

 

The Columbia College Sabbatical Leave Committee has submitted its recommendations regarding 2001-2002 sabbatical leave recipients.  The Committee’s recommendations have been reviewed and approved by the college president.

 

               Applicable Education Code sections require that employees who are granted sabbatical leaves either post a bond in an amount equal to the salary received during the period of the leave, or enter into an agreement with the Board of Trustees for the proportional repayment of the amount received during the leave if service is not provided the District in an amount twice the length of the leave.  (A copy of Resolution No. 00-01/03 is attached.)

 

RECOMMENDATION:           

That the Board of Trustees approve 2001-2002 sabbatical leaves for the following Columbia College academic employees:

            In addition, Resolution No. 00-01/03 is approved in lieu of a bond for the recipients.

 

8.        Parent Handbook - Child Care Center

 

For the purpose of state licensing and as a requirement of its contract with the California Department of Education, the MJC Child Care Center is required to prepare and distribute a Parent Handbook approved by our Parent Advisory Committee and the YCCD Board of Trustees.  The Parent Advisory Committee approved the Handbook on December 6, 2000. (Copies of the handbook were previously distributed to trustees).

 

RECOMMENDATION:           

The Board of Trustees approve the Parent Handbook for the MJC Child Care Center.

 

9.        q Agriculture Parking Lot - Change Order #2

 

The reconstruction of the Agriculture Parking Lot at the corner of Coldwell and College is complete.  Attached Change Order #2 represents additions for relocation of a catch basin and investigation for an abandoned septic tank and leach lines.

 

RECOMMENDATION:           

That the Board of Trustees approve Change Order #2 for the contract with Teichert Construction for Reconstruct Parking Lot at Modesto Junior College East Campus in the added amount of $1,592.21.

 

 

10.      q Culinary Academy  - Change Order #1

 

This project began as an effort to bring the fire suppression system in the Culinary Academy up to code to address a safety issue.  Since the original scope was developed, the instructional program began to include sales of their food product as part of the instructional component.  In order to meet the requirements as prescribed by the Stanislaus County Environmental Resources Department for a commercial kitchen, additional work is required.  In that the total change order exceeds ten percent over the total contract of $124,286 this requires Board approval.

 

Attached Changed Order #1 represents additions required by the Stanislaus County Environmental Resources Department in order that the Culinary Academy may function as a commercial kitchen.

 

RECOMMENDATION:           

That the Board of Trustees approve Change Order #1 for the contract with Paul Anderson Construction for the Culinary Academy at West Campus in the added amount of $69,785.

That the Board of Trustees authorize the Yosemite Community College District to submit the following project application and to enter into a contract with the appropriate donor agency when the project is selected for funding:

That the Board of Trustees grant retirement emeritus status to LeRoy Holmes, Electronics Instructor, Agriculture, Environmental Sciences & Technical Education, Modesto Junior College, effective January 1, 2002, and officially commend him for 31.5 years of valuable service to the District.

 

2.        Retirement - Classified

 

RECOMMENDATION:           

That the Board of Trustees grant retirement status to Jan Jorn, Public Information/Community Education Assistant at Columbia College, effective May 21, 2001, and officially commend her for 26 years of valuable service to the District.

RECOMMENDATION:           

That the Board of Trustees grant retirement status to Patricia Turner, Admissions and Records Evaluator, Admissions & Records, Modesto Junior College, effective December 30, 2000, and officially commend her for 32 years of valuable service to the District.

 

4.        Temporary Appointment - Academic

 

RECOMMENDATION:           

That the Board of Trustees approve the temporary appointment (personal leave replacement) of L. Leon Duke to the position of Computer Laboratory Instructor, Writing Center, Literature & Language Arts, Modesto Junior College, effective for the Spring 2001 semester.

RECOMMENDATION:           

That the Board of Trustees approve the temporary appointment of Martha Robles to Director/TRIO/Student Support Services, (Interim) Student Services, Modesto Junior College, effective January 2, 2001 to August 31, 2001.

RECOMMENDATION:           

That the Board of Trustees approve the probationary appointment (first year contract) of Sandra Woodside to Sociology Instructor, Business, Behavioral & Social Science, Modesto Junior College, effective Spring 2001.

19.       Termination of Probationary Employment - Classified

 

RECOMMENDATION:          

That the Board of Trustees approve the termination of probationary employment of Karen Willenberg, Secretary I, Columbia College, effective December 7, 2000.  This is a 50 percent position in the CalWorks Department.

 

20.       Reorganization - Classified

 

Administrative review of the Modesto Junior College Student Services, Admissions, Records, Matriculation and Student Information Center has resulted in a proposal to create an Administrative Secretary I position to the Director of Matriculation, Admissions and Records.  The following personnel recommendation is intended to reflect changes in responsibility consistent with this reorganized office responsibility.

 

RECOMMENDATION:           

That the Board of Trustees:

a.     Abolish the position of Secretary III (classified staff, range 20).

b.     Establish position of Administrative Secretary I (classified staff, range 22).

c.     Appoint Ms. Judy Drummond as Administrative Secretary I, effective January 2, 2001.

 

21.      Request for Reassignment

 

RECOMMENDATION:           

That the Board of Trustees approve the request of David Willson to transfer from his current assignment as Vice President of Instruction, Columbia College to faculty status at Columbia College, effective July 1, 2001.

 

22.      Temporary Increase in Assignment - Classified

 

RECOMMENDATION:           

That the Board of Trustees approve a temporary increase in assignment for Angela Brunton, Child Care Center Teacher at the Columbia College Toddler Center, from 40 hours per week, 10 months per year to 40 hours per week, 11 month per year, effective December 1, 2000 through June 30, 2001.

RECOMMENDATION:           

That the Board of Trustees approve a temporary increase in assignment for Kathy Diener, Child Care Teacher at the Columbia College Toddler Center, from 40 hours per week, 10 months per year to 40 hours per week, 11 months per year, effective the month of June 2001.

The next regular meeting will be held on Wednesday, February 7, 2001.   A special pre-session will be held at 3:30 p.m. at the construction site of Sierra Halls.  Closed session will follow at 4:30 p.m. and the open session at 5:00 p.m. in the YCCD Board Room, 2201 Blue Gum Avenue, Modesto.
